Terms of Service

These Terms set out the rules for using FlyKo. They matter most where safety and compliance are concerned: FlyKo records information, it does not certify aircraft or training.

Agreement to these terms

These Terms of Service (the "Terms") are a contract between you and FlyKo ("we", "us") and govern your use of the FlyKo website and application (the "Service").

By creating an account or using the Service you accept these Terms. If you are agreeing on behalf of a flight school or club, you confirm that you are authorised to bind that organisation, and "you" then means both you and that organisation.

If you do not agree with these Terms, do not use the Service.

Definitions

  • School: the flight school or flying club that holds a FlyKo workspace.
  • User: an individual with an account, acting as an administrator, instructor, student pilot, pilot or mechanic.
  • Customer Data: the aircraft, maintenance, flight and training records and any other content entered into the Service by a School or its Users.
  • Beta: a stage of the Service offered for evaluation and still under active development.

Accounts and eligibility

You must be at least 16 years old to hold an account. Where a student pilot is under 16, the School creates and supervises the account and is responsible for any parental consent the law requires.

You are responsible for the accuracy of your registration details, for keeping your password secret, and for everything done through your account. Tell us promptly at flyko2026@gmail.com if you believe your account has been used without your permission.

Roles and access

The Service separates data by role. An administrator runs the School's workspace: members, join codes, training programmes and documents, with access to all of the School's records. An instructor records lessons and keeps a file on each of their students. A student sees their own logbook and training record. A pilot books aircraft and logs their own flights. A mechanic sees the fleet and maintenance records but not student progress or lesson notes. Schools and Users must not try to reach data outside their role, and must not share credentials to get around these limits.

Acceptable use

You agree not to:

  • break the law or infringe anyone's rights while using the Service;
  • upload malware, or probe, scan or test the security of the Service without our written permission;
  • overload or disrupt the Service, or bypass its rate limits and access controls;
  • copy, resell or offer the Service to third parties except as allowed by a separate agreement;
  • reverse engineer the Service except to the extent the law expressly permits;
  • enter data about a person who has not agreed to be part of the School's workspace.

We may suspend access that puts the Service, its data or other users at risk.

Customer Data and ownership

As between you and FlyKo, the School owns its Customer Data. You grant us a limited licence to host, copy, process and display that data solely to operate and support the Service, to keep backups, and to improve the Service in an aggregated form that does not identify any person or School.

You are responsible for having the right to enter the Customer Data you provide and for the instructions you give other Users. You can export your data at any time while your account is active. On request within 90 days of your account closing, we will provide a final export, after which we delete the data as described in our Privacy Policy.

Your responsibilities for safety and compliance

FlyKo is a record-keeping tool. It does not determine airworthiness and it is not a substitute for the judgement of a licensed engineer, a certifying mechanic, a pilot in command or an aviation authority.

The reminders, interval calculations and status labels in the Service depend entirely on the data you enter. They are aids, not clearances. You remain solely responsible for meeting all maintenance, inspection, licensing and operational requirements that apply to your aircraft and your training, and for verifying every figure against your official technical records before you act on it.

Beta service and availability

The Service is currently offered as a Beta. It may change, break or lose features at short notice, and it is provided without any service level commitment. We aim for high availability but do not promise uninterrupted access, and we may run maintenance that makes the Service briefly unavailable.

We keep backups but you should also keep your own copies of records that matter to you, especially safety and compliance records.

Fees

The Service is free to use during the Beta. If we introduce paid plans, we will give you at least 30 days notice by email before any charge applies to you, and you will be able to stop using the Service before it does. Any future fees, taxes and payment terms will be set out in an order or plan description that forms part of these Terms.

Our intellectual property

The Service, including its software, design, logo and text, belongs to FlyKo and its licensors and is protected by intellectual property law. These Terms do not give you any right in the Service except the limited right to use it as described here. If you send us feedback or suggestions, we may use them without obligation to you.

Third-party services

The Service relies on providers such as our database, hosting and email partners, listed in our Security page. We are not responsible for third-party services we do not control, and your use of any external link or integration is at your own risk.

Disclaimer of warranties

To the fullest extent allowed by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be error free, that defects will be fixed, or that the data it displays is accurate or complete.

Limitation of liability

To the fullest extent allowed by law, FlyKo will not be liable for any indirect, incidental, special or consequential damages, or for lost profits, lost data, or grounding, delay or safety costs, arising out of or relating to the Service.

Our total liability for all claims relating to the Service in any 12-month period is limited to the greater of the fees you paid us for the Service in that period or EUR 100.

Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.

Indemnification

You will defend and indemnify FlyKo against third-party claims, damages and reasonable costs that arise from your Customer Data, your use of the Service in breach of these Terms, or your failure to meet a legal or regulatory duty that is yours to meet.

Term and termination

These Terms apply for as long as you use the Service. You may stop and close your account at any time. We may suspend or end your access if you breach these Terms, if required by law, or if we stop offering the Service, giving you reasonable notice where we can. Sections that by their nature should survive termination will do so, including ownership, disclaimers, liability limits and governing law.

Changes to these Terms

We may change these Terms as the Service develops. We will post the updated version with a new date and, for material changes, notify you by email or in the app at least 15 days before they take effect. Continuing to use the Service after that means you accept the new Terms.

Governing law and disputes

These Terms are governed by the laws of the Republic of Serbia, without regard to conflict of law rules. The competent courts in Serbia have exclusive jurisdiction, except that either party may seek urgent injunctive relief in any competent court. If you are a consumer, you keep the protection of any mandatory laws of your country of residence.
